Attention: This purchase of live instruction, and/or DVD(s), and/or forms is a license and not a sale. This product is provided under the following license which defines what you may do with the product and contains limitations on warranties and or remedies.  Instruction, Materials, Examination, and Forms License Agreement and Registration- Fill out completely or delays may result.  Carefully read this license and sign below. This license agreement is your proof of license. Treat it as valuable property.  A. License: Heur Evectic, Inc. ("we" or "us"), provides you with the storage media containing a DVD(s) ("video") and/or documents-e.g. manuals, exams and inspection forms-(all combined called the "product") and grants you a license to use the product in accordance with the terms of this license. The copyright and all other rights in the Product shall remain with us or our suppliers. You may not make copies of any portion or all of the Product. This product is not available to persons who train individuals who are not permanent employees of or contractors who work exclusively for the company listed below. It is also not available to companies or individuals who sell training services or to franchises or individuals affiliated in any way with franchises. You may not make recordings of any kind of the training program although you may take written notes during the training sessions when live training is being provided. A manual will be sent out to you as soon as can be reasonably provided after ordering the live training. At the time of order, an initial payment shown below will be due and payable (or charged if a card is used) to pay for the cost of the manual and other course materials. If a cancellation is made by you before 7 days before the scheduled seminar, an additional $50 dollars will be due and payable at that time. If a check is made out for a larger amount, (e.g. the full amount for the course) that check can be cashed with the remainder returned after deductions for the manual and the cancellation fee has been made. A full charge for the remainder of a credit card will be made after 7 days before the training seminar is scheduled so long as the seminar has not been cancelled by either of us at that time. We reserve the right to cancel the seminar if an inadequate number of individuals enroll. Notice of cancellation will be provided within a reasonable time after we have determined that the number of enrollees is inadequate. No refunds will be made after the week prior to the seminar unless we have canceled the seminar. If you have been charged or have paid the full amount for the training course and if the training seminar is canceled by us, our responsibility is limited to returning the portion of your payment which has already been paid by you for the training other than the manual and other items you have received. All sales are final. B. You (the registered user and trainer signed below) may: 1. Use the Product yourself only. If you wish to allow others to view the Product, you will need a further license for each additional person. You must contact us at (888) 466-4677 or (801) 466-4447 to add another to the license. Heur Evectic reserves the right to set the price for such additional licenses at the time of the supplemental license request. 2. view the product as many times as you wish so long as you are the only person viewing the product. C. You may not: 1. make copies of any portion or all of the Product. This includes a prohibition on transcription of the tape narration. 2. use the Product except as permitted in this license. 3. sell or resell the product 4. publish or distribute any of the images, scenes or sound in the product 5. rent, lease, assign or transfer the product 6. modify the product or add it into another product 7. allow other than the registered user or trainer listed below view the product 8.use the product to sell training services 9. train individuals who are not permanent employees of or contractors who work exclusively for the company listed below. D. Term: This license shall continue for as long as you use the Product. However, it will terminate if you fail to comply with any of its terms. You agree upon termination, to deliver the copies to us at our request. E. Limitation of warranties and liability: This product is provided on an "as is" basis, without any other warranties, or conditions, express or implied, including but not limited to warranties of merchantable quality, merchantability or fitness for a particular purpose, or those arising by law, statute, usage of trade or course of dealing. The entire risk as to the results and performance of the Product is assumed by you. Neither we nor our dealers or suppliers shall have any liability to you or any other person or entity for any indirect, incidental, special or consequential damages whatsoever, including but not limited to loss of revenue or profit , lost or damaged data or other commercial or economic loss, even if we have been advised of the possibility of such damages or they are foreseeable; or for claims by a third party. Our maximum liability to you, and that of our dealers and suppliers shall not exceed the amount paid by you for the product. The limitations in this section shall apply whether or not the alleged breach or default is a breach of a fundamental condition or term, or a fundamental breach. Some states do not allow the exclusion or limitation of liability for consequential or incidental damages so the above limitation may not apply to you. You agree you will not advertise any affiliation with the School of Building inspection, HE, etc., including, but not limited to, certification by the School of Building Inspection. F. General: This license is the entire agreement between us, supersedes any other agreement or discussions, oral or written and may not be changed except by a written signed agreement. This agreement shall be interpreted under the laws of the State of Utah and the United States, including U.S. copyright law with the exception that the Fair Use Doctrine shall not apply. You and HE agree that any claim, dispute, or controversy arising out of or in connection with this agreement, or any breach thereof (including violations of copyright that may have occur(red) during the series review period before this contract was signed, or during or after the term of this contract, whether discovered during or after this contract has been terminated), shall be finally settled by binding arbitration administered by Intermountain ADR Group of Salt Lake City, Utah or a comparable entity in Salt Lake City, Utah and conducted in accordance with the Utah Arbitration Act found in Utah Code 78-31a, arbitrated by an arbitrator in Salt Lake City, Utah, U.S.A. in accordance with the relevant rules, and judgement on the award rendered by the arbitrators may be entered in any court having jurisdiction thereof. The language of any such arbitration shall be English. If a dispute arises, no change in payment status may occur until after arbitration is complete, and then only in favor of the prevailing party. If any provision of this License is declared by a Court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be severed from the License and the other provisions shall remain in full force and effect. No recording of any kind is allowed during the instruction. You understand that you can be held responsible for the loss of payment that would have been made to us if you allow others to view the product regardless of your knowledge of which persons the product copy may have been passed on to if you allow others to view, have, or copy the product. It is critical because of the limitations of time in the classroom, continuity of instruction is critical in teaching, and class rules dictate, that in order for a student to make a comment or ask a question they must first raise their hand. The grave effects of not following this rule include the fact that other students will not be able to hear the instructor when he is interrupted, forcing them to either miss the point or forcing the instructor to repeat the information. This creates many frustrated students and significant delays in completing the class that day. You hereby agree to allow the instructor to charge students who break this rule to the extent that other students must be provided sections of the A live@ course on DVD for their review after the class is over. You also hereby agree that the instructor has the right to ask offending students to leave the classroom temporarily if the interruptions continue.

*The 8-Day and 9-Day Courses are very intensive. It is expected that most of your evenings and Sunday will be occupied viewing DVD= s of New Construction and Commercial Inspection instruction. If you order early enough , we can help reduce the stress and free up your evenings and Sunday by sending these DVDs out in advance so you can watch them at home before class begins. (This applies only if you are paying by credit card). If the DVDs are not returned the first day of class we will assume that you would like to purchase them, and $199 for the New Construction set and/or $149 for the Commercial Inspection set will be charged to your credit card. If you sign up too late for us to send any of these DVDs to you before class, you can make arrangements to borrow or purchase these additional DVDs from us after the class is over if you do not finish watching them during the class dates.
